ELLIOTT, J.:

The legal questions involved in this case were considered and determined in cases Nos. 5240 (p. 472, supra), and 5241 (p. 484, supra), against the same defendants and for the same crime, the only difference being for that in the present case they obtained from the Banco Español-Filipino the sum of P3,500, by means of a check for that amount.  Defendants were convicted of estafa and sentenced to two years and ten months of presidio correccional and to pay jointly and severally an indemnity of P4,640.50, with subsidiary imprisonment and costs.  Judgment affirmed.
