Defendant was convicted of robbery for breaking and entering a store and taking away, by force and taking away, by force and intimidation, certain a personal property valued at P10.25, and was sentenced to seven years of presidio mayor with the corresponding accessories and to return the property or to pay an indemnity. Considering the presence of the aggravating circumstances of nocturnity and dwelling, judgment affirmed.
