Defendant was charged in the Court of First Instance of Misamis Oriental with the crime of robbery in band with rapes, was found guilty of the crime of robbery only and sentenced to suffer an indeterminate penalty of from 10 years of prision mayor to 17 years and 4 months of reclusion temporal with the accessory penalties provided for by law to indemnify jointly and severally the offended parties in the amount of P172.50.

Case is remanded to the Court of Appeals, having appellate jurisdiction to review the judgment or sentence of the Court of First Instance appealed from, for further proceeding.
