The last paragraph of Article 267 of the Revised Penal Code provides that if the victim is killed or dies as a consequence of the detention, or is raped or subjected to torture or dehumanizing acts, the maximum penalty shall be imposed. In People v. Larrañaga, [47] this provision gives rise to a special complex crime. Thus, We hold that appellant Lando is guilty beyond reasonable doubt of the special complex crime of kidnapping and serious illegal detention with rape in Criminal Case No. 4481-R.
