Finally, the Court sustains the CA in holding Lopez entitled to attorney's fees in the amount often percent (10%) of the total monetary award pursuant to Article 111[54] of the Labor Code. Where an employee was forced to litigate and incur expenses to protect his rights and interest, the award of such fees is legally and morally justifiable.[55] Consistent with the prevailing jurisprudence,[56] however, the legal interest imposed on the monetary awards at the rate of twelve percent (12%) per annum (p.a.) should be reduced to six percent (6%) p.a., computed from the finality of this Decision until full payment. |
