Petitioner contends that since Dimas dela Cruz did not take the witness stand, he (petitioner) was deprived of his right to cross-examine him. Thus, the Court of Appeals should not have considered Dimas' statement as part of the res gestae. Our ruling in Ilocos Norte Electric Company v. Court of Appeals[6] is relevant. |
