| That on or about the 21st day of December, 2002, in the municipality of Malolos, province of Bulacan, Philippines, and within the jurisdiction of this Honorable Court, the above-named accused, taking advantage of his moral ascendancy and influence over his stepdaughter [Lisa], a 15-year old child, with lewd designs, did then and there wilfully, unlawfully and feloniously by means of force and intimidation kiss and touch the private parts of complainant against her will and consent.[7] | |||||

| Appellant was arraigned for the two charges of rape in Criminal Case Nos. 3580-M-2002 and 3581-M-2002; and one charge of acts of lasciviousness in Criminal Case No. 3579-M-2002 on February 3, 2003 to which he entered a plea of not guilty on all charges.[8] He was later arraigned on March 12, 2003 for the third charge of rape in Criminal Case No. 145-M-2003 to which he likewise pleaded "not guilty."[9] | |||||
