However, these exceptions do not obtain in the instant case. On the contrary, both the trial and appellate courts arrived at identical findings, and took a common and undivided view of the case that is, that petitioner is guilty of malicious prosecution. "In the absence of compelling reasons, the Court will not disturb the rule that factual findings of the lower tribunals are final and binding on this Court."[29]
