| As to the award of exemplary damages, Article 2229 of the New Civil Code provides that exemplary damages may be imposed by way of example or correction for the public good, in addition to the moral, temperate, liquidated or compensatory damages.[36] The claimant, however, must first establish his right to moral, temperate, liquidated or compensatory damages. In this case, because Spouses Suntay failed to prove their entitlement to moral or compensatory damages, there could be no award of exemplary damages. | |||||
