With respect to the penalty imposed, we agree with the imposition by the RTC and the CA on accused-appellant of the penalty of reclusion perpetua, considering the prohibition on the death penalty.[37] To conform to recent jurisprudence,[38] we hereby modify the exemplary damages awarded by increasing the amount from P50,000 to P100,000.
