| The RH Law is "void-for-vagueness" in violation of the due process clause of the Constitution. In imposing the penalty of imprisonment and/or fine for "any violation," it is vague because it does not define the type of conduct to be treated as "violation" of the RH Law. [46] In this connection, it is claimed that "Section 7 of the RH Law violates the right to due process by removing from them (the people) the right to manage their own affairs and to decide what kind of health facility they shall be and what kind of services they shall offer."[47] It ignores the management prerogative inherent in corporations for employers to conduct their affairs in accordance with their own discretion and judgment. | |||||
