While no compelling grounds exist to reverse the accused-appellant's conviction, to conform to prevailing jurisprudence, the Court finds it proper to modify the civil indemnity and exemplary damages imposed by the courts a quo. For each of the two counts of rape, the Court awards in AAA's favor P75,000.00 as civil indemnity ex delicto and P30,000.00 as exemplary damages. The courts a quo's award of P75,000.00 as moral damages in each count of rape is, on the other, hand sustained.[33] Lastly, the Court imposes an interest of six percent (6%) per annum on all the damages awarded, to be computed from the date of the finality of this judgment until fully paid.[34] | |||||

Prescinding from the above, the Court finds no grounds to reverse the herein assailed decision convicting the accused-appellant of one count of rape and of lascivious conduct. The Court likewise finds no error in the penalty, civil indemnity, and damages ordered by the CA relative to Criminal Case No. 12022. However, in Criminal Case No. 12021, the lesser penalty and damages imposed by the RTC are reinstated. Lastly, to conform to prevailing jurisprudence, an interest at the rate of six percent (6%) per annum shall be imposed on all the damages awarded to AAA in both Criminal Case Nos. 12021 and 12022, to be computed from the date of the finality of this judgment until fully paid.[54] | |||||

In précis, the Court finds no compelling ground to reverse the accused-appellant's conviction for two counts of simple rape by both the RTC and the CA. The Court likewise finds proper the CA's modification of the amount of civil indemnity and damages imposed by the RTC. In sum, the Court finds no compelling ground to reverse the accused-appellant's conviction for four counts of simple rape by both the RTC and the CA. However, to conform to prevailing jurisprudence, for each count of rape, the Court reduces the award of civil indemnity to P50,000.00, but increases the exemplary damages to P30,000.00.[26] Additionally, the Court imposes an interest of six percent (6%) per annum on all the damages awarded, to be computed from the date of the finality of this judgment until fully paid.[27] |
