In the present case, the Court already nullified the PIATCO contracts for being contrary to public policy in Agan. A substantial amendment to a contract awarded through public bidding, when such subsequent amendment was made without a new public bidding, is null and void. The PIATCO contracts contain material and substantial amendments that substantially departed from the bidded contract. If at all, the declaration of nullity of a contract only operates to restore things to their state and condition before the contract’s execution.[326]
