This is an appeal from the January 17, 2012 Decision[1] of the Court of Appeals in CA-G.R. CR.-H.C. No. 04069, affirming in toto the July 23, 2009 Decision[2] of the Regional Trial Court (RTC) of Caloocan City, Branch 127, finding accused-appellant Medario Calantiao y Dimalanta (Calantiao) guilty beyond reasonable doubt of violating Section 11, Article II of Republic Act No. 9165 or the Comprehensive Dangerous Drugs Act of 2002.

A charge for indirect contempt, such as disobedience to a court's lawful order,[54] is initiated either motu proprio by order of or a formal charge by the offended court, or by a verified petition with supporting particulars and certified true copies of documents or papers involved therein, and upon full compliance with the requirements for filing initiatory pleadings for civil actions in the court concerned.[55]  It cannot be initiated by a mere motion,[56] such as the one that petitioner filed.
