In view of Sumulong's positive identification of Lara, the CA was correct in denying Lara's alibi outright. It is well-settled that positive identification prevails over alibi, which is inherently a weak defense. Such is the rule, for as a defense, alibi is easy to concoct, and difficult to disapprove.[29]
