Regarding "AAA's" alleged delay of 10 months in reporting the incident to the authorities, the CA held that there is no behavioral norm that victims of sexual abuse follow in respect to the time-frame for making such report, each case being determined by its peculiar milieu and setting; and that assuming for argument's sake that there was indeed some delay in this case, such delay should not be construed as implying that the accusation might not have been true at all especially in light of the fact that the victim was a minor.[8]

P75,000.00 if the crime is qualified by circumstances  that warrant the imposition of the death penalty, the Court affirms the separate amounts of P75,000.00 for civil indemnity and moral damages, without need of any pleading and proof, but raises the amount of exemplary damages from P25,000.00 to P30,000.00.[66]

Lastly, we affirm the Court of Appeals' award of exemplary damages.  As held in People v. Llanas, Jr.,[82] "[t]he award of exemplary damages is also proper not only to deter outrageous conduct, but also in view of the aggravating circumstances of minority and relationship surrounding the commission of the offense, both of which were alleged in the information and proved during the trial." The appellate court's award of P25,000.00 as exemplary damages is raised to P30,000.00 for each of the three (3) counts of rape in keeping with the current jurisprudence on the matter.[83]

As to damages, we likewise uphold the CA's award of P75,000.00 as civil indemnity and P75,000.00 as moral damages for each count of rape. We however modify the award of exemplary damages and increase it from P25,000.00 to P30,000.00 following current jurisprudence.[31]

On a final note, aside from the award of P50,000.00 as indemnity  ex-delicto and P50,000.00 as moral damages, the accused should also pay the amount of P30,000.00 as exemplary damages. The award of exemplary damages is proper not only to deter outrageous conduct,[32] but also in view of the aggravating circumstance of minority which was alleged in the information and proved during the trial.
