In Bank of the Philippine Islands v. NLRC and Arambulo,[21] we ruled that an employee who has been dismissed for a just cause under Article 282 of the Labor Code is not entitled to separation pay. The complainant therein was likewise dismissed on the ground of loss of trust and confidence. Applying that rule to the instant case, we here hold that respondent is not entitled to separation pay. | |||||

The Bank should be reminded that for a dismissal based on loss of trust and confidence to be valid, the breach of trust must be willful, meaning it must be done intentionally, knowingly, and purposely, without justifiable excuse.[32] Loss of trust and confidence stems from a breach of trust founded on dishonest, deceitful or fraudulent act.[33] This is obviously not the case here. |
