As for damages, in the absence of any aggravating circumstances, and as found by the Court of Appeals, the heirs of the victim are entitled to a civil indemnity of P50,000.00, without need of proof other than that death which occurred as a result of the crime.  They are also entitled to moral damages in the sum of P50,000.00.[35]  Temperate damages, as likewise determined by the Court of Appeals in the amount of P25,000.00 is also granted.
