The OCA recommended that respondent sheriff be held liable for grave misconduct. For grave misconduct to exist, there must be substantial evidence showing that the acts complained of were corrupt or inspired by an intention to violate the law or were in persistent disregard of well-known legal rules.[22] It does not appear to the Court that the actuations of respondent sheriff were motivated by any of these. Therefore, respondent sheriff is liable for simple misconduct only.
