Sometime in the 1960s, Perfecta bought Lot No. 3771-B-1-A, with an area of 2,244 square meters, located at Inayawan, Cebu City (the dominant estate) from one Dionisio Abasolo, who formerly owned all the properties therein. Thereafter, Perfecta donated the dominant estate to Apolinardito, who is now the registered owner thereof.[4] Petitioners own QC Rattan Inc., a domestic corporation engaged in the manufacture and export of rattan-made furniture. In the conduct of their business, they use vans to haul and transport raw materials and finished products. As they wanted to expand their business and construct a warehouse on their property (the dominant estate), they asked for a right of way from Pedro sometime in April 1994.

The gravamen of rape is carnal knowledge of a woman against her will.[34] That appellant had an unconsented intercourse with private complainant was clearly shown by the following excerpts of the victim's testimony: Q: You mean, your uncle went inside your room? A: Yes, your Honor.

The Court, however, finds that on record the elements of rape on August 12, 1997, have been sufficiently established.  The gravamen of the offense of rape is carnal knowledge of a woman against her will or without her consent.[17] In Criminal Case No. 2000-0127-D, the victim testified that appellant abused her on said date, thus: PROS. MANAOIS:   Q: To refresh your mind, you said that the first date was on October 15, 1996 and the second time was October 22, 1996, when was the next time or third time? A: That was August 12, 1997 when I have just given birth, sir.   Q: What [was] that date again when you gave birth to your child Evangeline?

Worth noting also is the fact that the victim's testimony was interrupted by fits of crying, leaving no room for doubt that she was truthful in her narration of events and her sordid experience in the hands of appellant, whom she treated as her own father.[11]
