| In this case, the imposable penalty is imprisonment for not less than fourteen years and eight months and not more than seventeen years and four months. Under the Indeterminate Sentence Law, as applied to an offense punishable by a special law, the court shall sentence the accused to an indeterminate sentence expressed at a range whose maximum term shall not exceed the maximum fixed by the special law, and the minimum term not be less than the minimum prescribed.[55] Hence, the penalty imposed by the trial court of imprisonment from fourteen years and eight months to sixteen years and two months is in order. | |||||
