All the sums of money awarded to the victims and their heirs will accrue a six percent (6%) interest per annum from the time of this Decision until fully paid.[50] It should be noted, however, that since accused Velasquez no longer interposed an appeal before the Court, his liability shall be limited to the amounts awarded by the CA, since the latter's Decision has become final and executory with respect to him.[51]

We also affirm the trial court and CA in ordering appellant to pay the heirs of Jennifer Patawaran-Rosal the amounts of P50,000 as moral damages.  In cases of murder and homicide, the award of moral damages is mandatory, without need of allegation and proof other than the death of the victim.[59]Anent the award of civil indemnity, the same is increased to P75,000 to conform with recent jurisprudence.[60] As to expenses incurred for the funeral and burial of Jennifer, the CA correctly awarded her heirs the amount of P25,000 as actual damages, said amount having been stipulated by the parties during the trial.

There is similarly no reason for the Court to disturb the award of damages made by the court a quo.  Accused-appellant shall compensate private complainant for actual damages in the amount of P70,000.00 as the parties voluntarily stipulated during the pre-trial conference that private complainant incurred actual expenses in said amount because of his injuries.  Accused-appellant shall also be liable for moral damages suffered by private complainant in the amount of P25,000.00, in accordance with jurisprudence.[26]

The award of P20,000.00, as civil indemnity to each victim of attempted murder, is neither arbitrary nor excessive because such award is in line with this Court's ruling in People v. Gutierrez,[62] citing People v. Almazan.[63] The lower courts did not award moral and exemplary damages. To conform to this Court's current ruling in People v. Domingo,[64] awards of moral and exemplary damages in the amounts of P10,000.00 and P25,000.00, respectively,[65] to each victim, are in order.
