| Article 19 of the Civil Code expresses the fundamental principle of law on human conduct that a person "must, in the exercise of his rights and in the performance of his duties, act with justice, give every one his due, and observe honesty and good faith." Under this basic postulate, the exercise of a right, though legal by itself, must nonetheless be done in accordance with the proper norm. When the right is exercised arbitrarily, unjustly or excessively and results in damage to another, a legal wrong is committed for which the wrongdoer must be held responsible.[33] | |||||
