| The primary element of the crime of kidnapping is actual confinement, detention and restraint of the victim. There must be a showing of actual confinement or restriction of the victim, and that such deprivation was the intention of the malefactor.[32] Hence, having proven that detention was perpetrated by appellants, it is sufficient to convict them of the crimes of kidnapping and serious illegal detention. | |||||
