Neglect of duty is the failure of an employee to give one's attention to a task expected of him. Gross neglect is such neglect which, from the gravity of the case or the frequency of instances, becomes so serious in its character as to endanger or threaten the public welfare.[27] The term does not necessarily include willful neglect or intentional official wrongdoing.[28]

d) There must be, between the first and second actions, identity of parties, of subject matter and of cause of action. This requisite is satisfied if the two actions are substantially between the same parties.[66] For want of the fourth requisite that there must be, between the first and second actions, identity of parties, subject matter, and cause of action, the instant case is thus removed from the operation of the principle of res judicata. Stated differently, there is no identity of parties and issues in CAR Case No. 1649-P'74 and the instant case.
