As to exemplary damages, the victims or the heirs are likewise entitled to exemplary damages if aggravating circumstances, whether qualifying or generic, are present. In the case under review, treachery and evident premeditation were clearly established. Verily, an award of P25,000.00 as exemplary damages is justified. Under Article 2230 of the New Civil Code, exemplary damages are awarded to serve as a deterrent to serious wrongdoings, as vindication of undue suffering and wanton invasion of the rights of an injured person, and as punishment for those guilty of outrageous conduct.[55]
