The Court of Appeals convicted Banzuela of acts of lasciviousness under Article 336 of the Revised Penal Code in relation to Section 5(b) of Republic Act No. 7610. For Banzuela to be convicted as such, both the requisites of acts of lasciviousness under Article 336 of the Revised Penal Code as earlier discussed, and sexual abuse under Section 5 of Republic Act No. 7610, must be met and established by the prosecution.[64] The following are the elements of sexual abuse under Section 5, Article III of Republic Act No. 7610:(1) The accused commits the act of sexual intercourse or lascivious conduct;
