Secondly, the testimonies of the police officers have adequately established with moral certainty the commission of the crime charged in the information and the identity of Ambre as the perpetrator. At this juncture, the Court affirms the RTC's finding that the police officers' testimonies deserve full faith and credit. Appellate courts, generally, will not disturb the trial court's assessment of a witness' credibility unless certain material facts and circumstances have been overlooked or arbitrarily disregarded.[23] The Court finds no reason to deviate from this rule in this case.

As no ill motive can be imputed to the prosecution's witnesses, we uphold the presumption of regularity in the performance of official duties and affirm the trial court's finding that the police officers' testimonies are deserving of full faith and credit.  Appellate courts generally will not disturb the trial court's assessment of a witness' credibility unless certain material facts and circumstances have been overlooked or arbitrarily disregarded. [14]  We find no reason to deviate from this rule in the instant case.

Incestuous rape is not an ordinary crime that can be easily fabricated or manufactured. The very parties involved in it, let alone the psychological toll, social scandal and humiliation it is likely to generate, are already deterrent factors against its concoction. The victim, the perpetrator, nay, the entire family must deal with a crisis that goes to the very core of familial integrity. In fine, the Court has every reason to believe that in going to court, [the victim] is simply seeking justice for the bestial acts done to her even if the ax has to fall against her very own father.[19]

In determining the guilt or innocence of the accused in cases of rape, the victim's testimony is crucial in view of the intrinsic nature of the crime in which only two persons are normally involved. The accused may be convicted on the basis of the victim's lone and uncorroborated testimony provided it is clear, positive, convincing, and consistent with human nature.[23]
