| While De Guzman was decided after Magbaleta, the principle enunciated in the Magbaleta is the one that now prevails because it is reiterated in the subsequent cases of Gonzales v. Lopez,[23] Esquivias v. Court of Appeals,[24] Spouses Hontiveros v. Regional Trial Court, Branch 25, Iloilo City,[25] and the most recent case of Martinez v. Martinez.[26] Thus, Article 151 of the Family Code applies to cover when the suit is exclusively between or among family members. | |||||
