The petitioners took advantage of their respective official positions because they had the duty to make or to prepare, or otherwise to intervene in the preparation of the document, or have the official custody of the document which they falsified.[27] Zapatos, as a member and, at the time, Temporary Presiding Officer of the Sangguniang Panglungsod, had the duty to make or prepare or intervene in the preparation of the assailed resolutions. In like manner, Mayor Regidor cannot claim that as mayor he had no participation in the making, or preparation of, nor any intervention in the assailed resolutions.
