| Next, Solidum claims that due to the extension of his period of preventive suspension, he must be considered as having been constructively dismissed and entitled to reinstatement and backwages. To support his claim, Solidum cites Maricalum Mining Corporation v. Decorion[22] Such case, however, is not factually on all fours with the instant case. In Maricalum, the Court ruled that Decorion was illegally constructively dismissed, which is why he was entitled to reinstatement. Here, Solidum was validly dismissed for loss of trust and confidence. Thus, his reliance on Maricalum is misplaced and will not justify his reinstatement. | |||||
