In Reyes v. Alsons,[30] the petitioner filed a petition for annulment of judgment raising the issue of the RTC's lack of jurisdiction to enforce the lower court's judgment. This Court held that this jurisdictional issue has been resolved in the previous cases filed by the petitioner. Thus, the petition for annulment of judgment was barred by res judicata and the policy against forum shopping.[31]

In Ramon Jimenez, Jr. v. Juan Jose Jordana,[140] the issue to be resolved was whether the nature of the action was one for specific performance or for recovery of real property. In determining that the case was one for the recovery of real property, the Court characterized the suit on the basis of the allegations in the Complaint. We restated the rule that the nature of an action is determined by the material averments in the complaint and the character of the relief sought. In the recent case of Reyes v. Alsons Development and Investment Corporation,[141] we likewise ruled that the nature of an action is determined by the allegations in the pleadings.

Forum shopping exists when the elements of litis pendentia are present or when a final judgment in one case will amount to res judicata in the other.[22] Among its elements are identity of the parties, identity of the subject matter and identity of the causes of action in the two cases.[23]

The Court at this juncture thus reminds Pyramid's counsel to observe Canon 12 of the Code of Professional Ethics which enjoins a lawyer to "exert every effort and consider it his duty to assist in the speedy and efficient administration of justice," and Rule 12.04 of the same Canon which enjoins a lawyer "not [to] unduly delay a case, impede the execution of a judgment or misuse court processes."   And the Court reminds too the trial judge to bear in mind that the nature of an action is determined by the allegations of the pleadings[51] and to keep abreast of all laws and prevailing jurisprudence, consistent with the standard that magistrates must be the embodiments of competence, integrity and independence.[52]
