The award for civil indemnity is mandatory and is granted to the heirs of the victim without need of proof other than the commission of the crime. Hence, the award of civil indemnity of P50,000.00 to the heirs of Francisco Ala is proper.[36] | |||||

There is treachery when the offender commits any of the crimes against persons, employing means, methods, or forms in their execution, without risk to himself arising from the defenses which the offended party might make.[17] The essence of treachery is the unexpected and sudden attack on the victim which renders him unable and unprepared to defend himself due to the suddenness and severity of the attack.[18] In this case, the victims were conversing in front of the house of Juanito Hidalgo when they were suddenly fired upon. They had no way of knowing that the attack would be made and they had no opportunity to defend themselves. Hence, both the trial court and the Court of Appeals correctly appreciated the aggravating circumstance of treachery. | |||||

Thus, we reach the inescapable conclusion that the trial court and the Court of Appeals were correct in finding appellants guilty of two counts of murder and affirm the imposition of reclusion perpetua upon them for each of the murders committed. Likewise, in line with recent jurisprudence,[58] we affirm the award of damages in favor of the heirs of the victims. | |||||

In light of the foregoing, the Court holds that the finding of guilt as pronounced by the RTC and the Court of Appeals should be sustained. With respect to the civil liability of appellant, the award should be modified in light of prevailing jurisprudence. Therefore, appellant is ordered to indemnify the heirs of Ronaldo RaƱin in the amount of P50,000.00 as civil indemnity, P18,500.00 as actual damages for funeral expenses, P50,000.00 as moral damages, and P25,000.00 as exemplary damages.[45] |
