The rule of pari delicto is expressed in the maxims 'ex dolo malo non eritur actio' and 'in pari delicto potior est conditio defedentis.' The law will not aid either party to an illegal agreement. It leaves the parties where it finds them.[49] The application of the pari delicto principle is not absolute, as there are exceptions to its application. One of these exceptions is where the application of the pari delicto rule would violate well-established public policy.[50] |
