| On March 16, 2007, the CA promulgated its Decision[39] in CA-G.R. SP No. 88098 denying the petition for lack of merit. It ruled that the RTC committed no grave abuse of discretion amounting to lack of or in excess of jurisdiction when it recalled the writ of execution with break open order. It held that the expiration of the lease contract between petitioner and the government and the latter's take-over and/or repossession of the premises from respondents were supervening events. | |||||
