| Finally, on the issues of estoppel and laches, such were not raised before the trial court. Hence, we cannot rule upon the same. It is settled that an issue which was neither alleged in the complaint nor raised during the trial cannot be raised for the first time on appeal, as such a recourse would be offensive to the basic rules of fair play, justice and due process, since the opposing party would be deprived of the opportunity to introduce evidence rebutting such new issue.[41] | |||||
