PER CURIAM
Conformably therewith, in People vs. Hipolito Diaz y De Guzman,[48] the Court held:"It is well settled that the right to be heard by himself and counsel is one of the constitutional rights granted to the accused. Not only this but he likewise has the right to present evidence for his defense. Accordingly, denial of due process can be successfully invoked where no valid waiver of rights has been made, as in the instant case.
