The Constitution under Section 1, Article VIII expressly directs the Judiciary, as a matter of power and duty, not only to settle actual controversies involving rights which are legally demandable and enforceable but, to determine whether or not there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch or instrumentality of the Government. We thus have the duty to take cognizance of allegations of grave abuse of discretion in this case,[20] involving the sale by PSALM of a power plant, which supposedly contravenes the policy on competitive public bidding.

The following essential elements must therefore be present: (1) the accused must be a public officer discharging administrative, judicial or official functions; (2) the accused must have acted with manifest partiality, evident bad faith or gross inexcusable negligence; and (3) the action of the accused caused undue injury to any party, including the government, or gave any private party unwarranted benefits, advantage or preference in the discharge of the functions of the accused.[19]
