Upon the denial of its "Affidavit of Third Party Claim"  by the RTC of Manila,[14] petitioner commenced with the RTC of Boac, Marinduque,  presided by Judge Leonardo P. Ansaldo, a complaint for reivindication of properties, etc., with prayer for preliminary injunction and temporary restraining order against respondents Solidbank, Marcopper, and sheriffs Bajar and Jandusay.[15] The case was docketed as Civil Case No. 98-13.
