Unlike suits for forcible entry, prior physical possession is not required in unlawful detainer cases.[30] However, it is still incumbent for the plaintiff to prove his or her right to possess the subject property, since the very issue in unlawful detainer cases is who between the plaintiff and the defendant has a better right to possess the property in question.[31]
