PEOPLE v. ERNESTO UYBOCO Y RAMOS

LEONARDO-DE CASTRO, J.
The testimonies of Fernandez and Augusto, which were believed by both the trial court and the Court of Appeals, clearly attribute all the elements of kidnapping and serious illegal detention to accused-appellant Niegas and his companions, collectively.  Specifically, Fernandez's and Augusto's testimonies proved that the offenders detained Fernandez, a female, and James, a minor, for more than three days, for the purpose of extorting ransom.  The mere circumstance that accused-appellant Niegas did not personally perform all the acts necessary to consummate the crime is irrelevant when conspiracy is proven, since in conspiracy, the act of one is the act of all.[31]
