| Dissatisfied with the trial court's rulings, the intestate estate of Manolita, represented by Mediatrix, filed a petition for certiorari in the Court of Appeals[12] which, however, in a decision[13] dated August 9, 2007, dismissed it. It ruled: [W]e sustain the finding of [the trial court] that the death of Zenaida did not extinguish the relationship by affinity between her husband, private respondent Sato, and her mother Manolita, and does not bar the application of the exempting circumstance under Article 332(1) of the Revised Penal Code in favor of private respondent Sato. | |||||
