PEOPLE v. ROMEO LEDESMA

DEL CASTILLO, J.
Treachery is evident in this case as the suddenness and unexpectedness of the assault deprived the victims of an opportunity to resist it or offer any defense of their persons. This is considering that the victims were unaware that they would be attacked by appellants with a hail of bullets from their firearms fired at close range. Indeed, "[t]he suddenness of the attack, without the slightest forewarning thereof, placed the [victims] x x x in such a position that they could not have defended themselves from the aggression x x x."[26]

BELLOSILLO, J.
As found by the trial court and the Court of Appeals, the testimonies of the prosecution witnesses were consistent, in accord with one another, and were given in simple, straightforward manner, mentioning details of the incident that could not have been merely concocted. As long as the witnesses concur on material points, slight deviations in their recollection of details will not detract from the essential veracity of their assertions.[17]
