| In the Pre-Trial Order[26] of the RTC dated April 4, 1995, the parties agreed to limit the issue with regard to Lot No. 707 as follows: whether or not respondent Emilia is the owner of the eastern half portion of Lot No.707. The petitioners' supporting theory for this issue was that "the Deed of Quitclaim dated November 28, 1961 was rendered ineffective by the issuance of [TCT No. 42244] in the name of Felipa and Hilaria."[27] On appeal to the CA, however, the petitioners raised a new theory by questioning the execution and enforceability of the Deed of Quitclaim. They claimed that it is actually a donation that was not accepted in the manner required by law.[28] | |||||
