| The Court further held in People v. Manuel [28] that: One should not expect a fourteen-year old girl to act like an adult or mature and experienced woman who would know what to do under such difficult circumstances and who would have the courage and intelligence to disregard a threat on her life and complain immediately that she had been forcibly deflowered. It is not uncommon for young girls to conceal for sometime the assaults on their virtue because of the rapist's threat on their lives, more so when the rapist is living with her.[29] | |||||

| Accused-appellant's contention that the rape could not have happened because he and AAA were sleeping with other persons, including AAA's mother, in the same room when the alleged rape incidents took place does not hold water. The crime of rape may be committed even when the rapist and the victim are not alone. Rape may take only a short time to consummate, given the anxiety of its discovery, especially when committed near sleeping persons oblivious to the goings on. Thus, the Court has held that rape is not impossible even if committed in the same room while the rapist's spouse is sleeping or in a small room where other family members also sleep.[24] | |||||

| The Court has in the past ruled that rape may be committed even when rapist and victim are not alone. In fact, rape was held to have been committed in the same room while the rapist's spouse was asleep, or in a small room where other family members also slept.[20] As AAA stated in her testimony, her father molested her during times when they were alone in the room. This explains why the other members of the family were not aware that appellant was sexually abusing AAA. | |||||
