PNB's and NIDC's Notice of Appeal was denied due course for having been filed out of time. On June 11, 1992, they filed a Petition for Certiorari before the Court of Appeals to nullify the order denying their notice of appeal. But the Court of Appeals denied the petition. That prompted the elevation of the case to this Court via a Petition for Review on Certiorari, docketed as G.R. No. L-08870. This Court at first denied the petition on March 3, 1994.[31] However, on a Motion for Reconsideration, the Court ordered the lower court to give due course to the appeal.[32]
