RADIO COMMUNICATIONS OF PHILIPPINES v. NLRC

This case has been cited 1 times or more.

2006-10-16
CHICO-NAZARIO, J.
While it is true that the general rule is that only errors which have been stated in the assignment of errors and properly argued in the brief shall be considered, this Court has also recognized exceptions to the general rule, wherein it authorized the review of matters, even those not assigned as errors in the appeal, if the consideration thereof is necessary in arriving at a just decision of the case, and there is a close inter-relation between the omitted assignment of error and those actually assigned and discussed by the appellant.[140]  Thus, the Court of Appeals did not err in awarding the damages when it already made findings that would justify and support the said award.
