Appeal as a remedy is available only in cases where there is an error of judgment on the part of a court, tribunal or quasi-judicial agency.[12] An error of judgment is one which a court may commit in the exercise of its jurisdiction and which error is reviewable only by appeal.[13] It is, therefore, an instance where a court having jurisdiction on the subject matter of the case renders an erroneous decision.
