Petitioner attributes the filing of the erroneous Complaint before the RTC to her former counsel's mistake or gross ignorance.[19] But even said reason cannot save petitioner's Complaint from dismissal. It is settled in this jurisdiction that the client is bound by the acts, even mistakes, of the counsel in the realm of procedural technique.[20] Although this rule is not a hard and fast one and admits of exceptions, such as where the mistake of counsel is so gross, palpable and inexcusable as to result in the violation of his client's substantive rights,[21] petitioner failed to convince us that such exceptional circumstances exist herein.
