| The COMELEC First Division should have been more cautious in dismissing petitioner's appeal on the mere technicality of non-payment of the additional P3,200.00 appeal fee given the public interest involved in election cases. This is especially true in this case where only one vote separates the contending parties. The Court stresses once more that election law and rules are to be interpreted and applied in a liberal manner so as to give effect, not to frustrate, the will of the electorate.[42] | |||||
